35 Applicant respectfully petitions the office to withdraw the subject Application from

issue for consideration of a request for continued examination (RCE) in compliance with
37 CFR § 1.114., as permitted under 37 CFR § 1.313(c)(2).

The allowed Application is defective because references that had been
40 considered in a co-pending application have not been considered by the Examiner in
the subject Application.
